      TO:      REGISTRANTS OF PESTICIDE PRODUCTS
      
      SUBJECT: CONCURRENT REVIEW OF NEW PESTICIDE PRODUCTS
               BY THE U.S. ENVIRONMENTAL PROTECTION AGENCY
               AND THE DEPARTMENT OF PESTICIDE REGULATION 
      
      
      Currently, the Department of Pesticide     
      Regulation (DPR) accepts applications for
      registration in California of the following types of
      pesticide products prior to registration of the
      products by the U.S. Environmental Protection  
      Agency (U.S. EPA):
      
      1.  Spray adjuvants (not required to be federally
                registered);
      
      2.  Experimental Use Permits;
      
      3.  New products containing new microbial active
                ingredients; 
      
      4.  New products containing new biochemical active
                ingredients; and 
      
      5.  New products, containing new active ingredients,
                which have been designated by U.S. EPA as
                "reduced risk." 
      
      Effective immediately, as a part of DPR's continuing
      effort to support the development of reduced risk
      pesticides, DPR will also accept for concurrent
      review, applications for registration of the
      following types of pesticide products prior to
      registration of the products by U.S. EPA:  
      
      1.  New products containing biochemical active
                ingredients currently registered in California;
                and 
      
      2.  New products which have been designated by  
                U.S. EPA as "reduced risk" that contain active
                ingredients currently registered in California. 
      
             
      
      WHEN TO SUBMIT AN APPLICATION FOR CONCURRENT REVIEW:
      
      Spray Adjuvants: 
      
      Pesticides which are spray adjuvants do not require
      federal registration, and therefore, may be submitted
      to DPR for review at any time.  
      
      Experimental Use Permits: 
      
      An application for use of a pesticide under a federal
      Experimental Use Permit may be submitted to DPR at the
      same time as it is submitted to U.S. EPA for review.  
      
      Products Containing New Microbial Active Ingredients:  
      
      An application for registration of a new pesticide
      product containing a new microbial active ingredient 
      may be submitted to DPR at the same time as it is
      submitted to U.S. EPA for review.  
      
      Products Containing New or Currently Registered
      Biochemical Active Ingredients:  
      
      An application for registration of a new pesticide
      product containing either a new or currently
      registered biochemical active ingredient may be
      submitted to DPR at the same time as it is submitted
      to U.S. EPA for review.  
      
      Reduced Risk Products:  
      
      An application for registration of a new pesticide
      product, containing either a new or currently
      registered active ingredient, may be submitted to DPR
      after U.S. EPA has determined that the product fits
      their reduced risk criteria.  Applicants must provide
      DPR with documentation of the U.S. EPA determination.  
      Please clearly note in the cover letter accompanying
      any of the above types of submissions that the product
      is not yet federally registered and indicate which of
      the above criteria the product meets.  
      
      All of these types of submissions will be reviewed in
      the order received, along with all other applications
      for registration of pesticide products.   
           
      These changes are not a reduction in any of the data
      requirements.  All required data and information must
      still be submitted.  In addition, California
      registration of the product will not be granted until
      the U.S. EPA stamped approved label and accompanying
      letter are received by DPR.    
      
      This policy change provides registrants of pesticide
      products with the opportunity to initiate the
      California registration process for reduced risk
      pesticides prior to U.S. EPA's final approval of a
      product.
