Enforcement Response Policy

The goal of the enforcement program of the Department of Pesticide Regulation (DPR) and the County Agricultural Commissioners is to protect public health, property, pesticide handlers and fieldworkers, and the environment of the State of California.

The enclosed pesticide Enforcement Response Policy is intended to strengthen environmental enforcement and affect statewide consistency of enforcement responses used by the County Agricultural Commissioners when acting upon pesticide violations. This policy was approved by the California Agricultural Commissioners and Sealers Association on August 18, 2005, and is effective immediately. It replaces and supersedes the “Enforcement Guidelines” document of December 1994 and its Technical Revision of December 2002.

You may also find it helpful to refer to ENF 2004-028, District Attorney Participation In Cases, when implementing certain requirements of this policy. This letter and its enclosures are located on DPR´s Website at: www.cdpr.ca.gov/docs/county/cacltrs/penfltrs/penf2004/2004028.htm

During the next few weeks, we will be posting the Enforcement Response Policy on DPR´s Website in the places where the Enforcement Guidelines currently reside.
