Amendment To Title 3, California Code of Regulations Section 6860(a) and (b)
Enclosed for your information is the revision to section 6860(a) and (b). Toxic Air Contaminants List, Title 3, California Code of Regulations (Regulations), Division 6. Pesticides and Pest Control Operations, prepared by the Department of Pesticide Regulation. This amended regulation became effective June 21, 2003.
On May 22, 2003, the Office of Administrative Law added to section 6860(a) the pesticide, methyl isothiocyanate (MITC), and other pesticides that generate MITC as toxic air contaminants, pursuant to Food and Agriculture Code section 14023.
Office of Administrative Law also added three pesticides to section 6860(b), pursuant to Food and Agriculture Code section 14021: carbon disulfide- generating pesticides, 10 10′ oxybisphenoxyarsine, and phosphine and phosphine-generating pesticides.
Enforcement letter 03-20 provided the most recent version of the Regulations section of your Enforcement Manual. Please use this enclosure as a master copy to replace page 218 of the Regulations section of your Enforcement Manual.
