Director’s Decision on an Appeal of a County Agricultural Commissioner Decision (Docket Number 133)

Enclosed is Administrative Docket Number 133, which contains the Director’s Decision on an Appeal of an Agricultural Civil Penalty, levied against Bennett Landscape by the Los Angeles County Agricultural Commissioner (CAC) for violations of Title 3, California Code of Regulations (3CCR) sections 6602, 6678, 6702(b)(5), 6738(b)(1)(C), 6738(c)(1)(C), and 6726.

In the above case, the CAC proposed a fine of $50 (Class C) for a violation of 3CCR section 6726, failure to post emergency medical information. While the Director found that the posting of emergency medical information is an important requirement to employee protection and that this violation also created a reasonable possibility of harm to the employee (Class B), the Director does not have the authority to increase the fine originally set forth in the Notice of Proposed Action issued by the CAC. Therefore, the fine remains at $50.
