Interim Recommended Permit Conditions for Chlorpyrifos Used to Produce an Agricultural Commodity: Addition to Compendium Volume 3, Restricted Material and Permitting

This letter adds interim recommended permit conditions to Volume 3, Restricted Material and Permitting for the use of chlorpyrifos when used to produce an agricultural commodity. These interim recommended permit conditions have been issued to coincide with the effective date of the regulation making chlorpyrifos a restricted material when used to produce an agricultural commodity. These interim recommended permit conditions establish minimum requirements statewide. The Department of Pesticide Regulation is currently in the process of completing a risk assessment for chlorpyrifos. It is anticipated that this risk assessment will be completed by the end of the year. The recommended permit conditions may change based upon the results of that risk assessment.

The interim recommended permit conditions are similar to the requirements of the U.S. EPA labels, but add an additional measure of protection by:

  • Increasing the setback distances adjacent to sensitive sites (as defined on the label or designated by the County Agricultural Commissioner) around all applications;
  • Requiring specific practices related to wind speed at the time of application, spray direction and nozzle shut off.
