Notification, Application-Specific Information, and Early Entry Regulations – Frequently Asked Questions
The Department completed training of County Agricultural Commissioner (CAC) staff on the revised subject regulations in December of 2009. Further interpretive guidance on these regulatory sections is enclosed in the form of frequently asked questions (FAQs) received prior to and during the training period.
The notification, application-specific information and early entry regulations in Title 3, California Code of Regulations (3CCR) were amended, effective September 12, 2009, to clarify the notification requirements prior to and after a pesticide application; revise the requirements for displaying information on finding the location of application-specific information to fieldworkers; provide specific requirements for not allowing employees to enter a treated field during a restricted entry interval (REI); clarify the specific activities that are allowed if employees must enter a treated field during a REI; and clarify the requirements employers must meet in order to send employees into a treated field while the REI is in effect.
The highlighted text of revised 3CCR sections 6618, 6619, 6761.1, 6770 and 6771 can be found at www.cdpr.ca.gov/docs/legbills/rec_adopted/rei/text_final.pdf for a period of time. The final regulations are at www.cdpr.ca.gov/docs/legbills/calcode/chapter_.htm.
