Pesticide Use Enforcement Program Standards Compendium Volume II – 2005 Laws Section and 2005 Summary of Changes

The Department of Pesticide Regulation (DPR) is issuing a Pesticide Use Enforcement Program Standards Compendium (Compendium), comprised of various volumes, each addressing programs or topics. The Compendium was described in Enforcement Letter 05-02.

Volume II of the Compendium consists of laws and regulations pertinent to the pesticide regulatory program. Referred to as the Enforcement Manual, Volume II, is being issued in two separate sections, “Laws” section and “Regulations” section due to the size of the sections.

The “Laws” section, prepared by the DPR, includes excerpts from the following codes related to the pesticide regulatory program: Food and Agricultural Code (FAC), Business and Professions Code (B&P), Health and Safety Code (H&S) , and Labor Code (Labor).

Legislative changes to the FAC made during 2003, after the release of the last Enforcement Manual and all legislative changes made during 2004, have been incorporated. Changes are identified according to code section in the enclosed “2005 Summary of Changes.”

Legislative changes made to the Business and Professions Code during 2003 and 2004, have also been incorporated; however, no summary of changes has been provided. Check the Structural Pest Control Board Web site for information. No legislative changes were made to the excerpts of the Health and Safety Code or to the Labor Code.

Copies of the entire “Laws” section, based upon information provided by each county agricultural commissioner staff to its enforcement branch liaison, will be sent or delivered to each county – this year only. The “Laws” section has been reformatted for several reasons, including extensive legislative changes to various sections and to increase the ease of readability; therefore, the entire “Laws” section is being replaced. A compact disk will also be included. Reproductions may be made from either the “Laws” section or the compact disk.

Updated pages for legislative changes made to the FAC during 2005, and future years will be sent annually. For updates to laws relating to the practice of Structural Pest Control, visit the Structural Pest Control Board´s Web site.

The Governor’s Reorganization Plan 1 of 1991 has not been included with this year’s “Laws” section.
