Updates to Compendium Volume 2, Laws and Regulations

This letter announces the availability of and summarizes updates to Volume 2, Laws and Regulations, of the Pesticide Use Enforcement Program Standards Compendium. A table of sections changed in Volume 2 is enclosed. An updated Compendium Volume 2 will be available on the CalPEATS Help Resources page.

Title 3 California Code of Regulations (3CCR) Updates

Civil Penalty Fines. Increase maximum fine for Class A and Class B violations in administrative civil penalties levied by County Agricultural Commissioners (CACs) to $15,000 and $3,000 respectively, effective July 1, 2024.

Business and Professions Code (BPC) Updates

Structural Pest Control Board. Operation and authority to appoint a registrar extended to 1/1/2028.

Structural Fumigation Enforcement Program. Extended to 1/1/2029.

Food and Agricultural Code (FAC) Updates

DPR Environmental Justice Advisory Committee. Establish and convene by 1/1/2026.

Unmanned Pest Control Aircraft Pilot Certificates:

  • Private Applicator: Status added; pest control production agricultural application only to property of pilot or pilot’s employer; completion of accredited program; examination.
  • Journeyman: Authority to adopt regulations.

Produce carrying pesticide residue. Pursuant to amended CA Code of Civil Procedures, dollar cap on CA limited civil cases increased to $35,000.

Neonicotinoid Non-agricultural Use. Effective 1/1/2025, no possession/non-agricultural use except by CA certified applicators; no sale except by CA licensed dealers.

Diphacinone. Regulate diphacinone similar to second generation anticoagulant rodenticides.

Civil Penalties: Bee Regulations. Violation of FAC Section 29102 added to FAC Section 12999.5(a) list of violations under CAC civil penalty authority.
