Updates to Compendium Volume 2, Laws and Regulations

This letter announces the availability of, and summarizes updates to, Volume 2, Laws and Regulations, of the Pesticide Use Enforcement Program Standards Compendium.

A table of updates and corresponding Volume 2 pages that were updated (PDF format) are enclosed. An updated Compendium Volume 2 will be posted on the CalPEATS Help Resources page.

Title 3 California Code of Regulations (3CCR) Updates

  • Exempted Pesticide Products. Updates to conform with 2015 revisions of Title 40 Code of Federal Regulations (40CFR) 152.25.

Title 16 Professional and Vocational Regulations (16CCR) Updates

  • Application Forms. Revised to remove questions about criminal history or status of any pending criminal action, from application for initial operator, field representative, or applicator license and for company registration certificate, to reduce barriers to licensure for individuals with prior criminal convictions (AB 2138 compliance).
  • Substantial Relation Criteria and Criteria for Rehabilitation. For licensing and discipline decisions, establishes criteria to determine when a crime is substantially related to their qualifications, functions, and duties and establishes criteria for determining rehabilitation of a criminally convicted applicant or licensee (AB 2138 compliance).
  • Wood Destroying Organism (WDO) Fee. Increase to $4.00 per WDO inspection report adopted.

Business and Professions Code (BPC) Update

  • Legislative committee non-substantive revisions of the Business and Professions Code.

Food and Agricultural Code (FAC) Updates

  • Second generation anticoagulant rodenticides (SGARs). Prohibits use of four SGARs (with exceptions) until the Department of Pesticide Regulation (DPR) revaluation is completed and any necessary additional restrictions are adopted.
  • Bees: Enforcement and Penalties. Legislative counsel nonsubstantive changes to maintain the codes.

Health and Safety Code (HSC) Updates

  • Medical supervision. Extends repeal of medical supervisor, laboratory reporting, and consultation requirements to January 1, 2023.
  • Chlorpyrifos. Legislation mandates quarterly reports by DPR about use of chlorpyrifos in granular form.
