Updates to Compendium Volume 2, Laws and Regulations and Updates to Enforcement Charts

This letter announces the availability of and summarizes updates to Volume 2, Laws and Regulations, of the Pesticide Use Enforcement Program Standards Compendium. A table of sections changed in Volume 2 and updates to Enforcement Charts is enclosed. An updated Compendium Volume 2 will be available on the CalPEATS Help Resources page.

Effective July 2, 2024, Assembly Bill (AB) (AB) 2113 (Chapter 60, Statutes of 2024) was signed into law. The Enforcement Charts were updated to reflect the bill’s amendments.

Food and Agricultural Code (FAC) Updates

Definitions. Integrated pest management; Sustainable Pest Management (SPM).

Sustainable Pest Management. Legislative intent for implementation of SPM in California.

Advance notice to stakeholders of licensing, certification, registration fee increases.

Pest control business license exemptions.

Registration/reevaluation/mitigation. Process transparency; timelines; reporting; data; cancellation/refusal.

Mill assessments. Who pays; rate increase timelines; statute of limitations extended.

Pesticide container recycling records. Retain for four years.

Pest control dealer violations. Reassign civil penalty authority from CACs to DPR.

Enforcement actions. Increased the statute of limitations for any actions taken under Article 12 (such as FAC section 12999.5) from two to three years for all violations documented on or after July 2, 2024.

Permit review. Limited to specified issues; procedures; metrics; reporting.

Public Resources Code (PRC) Update

California Environmental Quality Act (CEQA). DPR Section 18 approval exempt from review.

Enforcement Charts Update

Amended FAC section 13000(a) increases the statute of limitations for actions taken under Article 12 (such as actions taken under FAC section 12999.5) from two to three years for all violations cited after July 2, 2024. For all violations cited prior to July 2, the statute of limitations remains two years. To reflect those changes, the Enforcement and Compliance Options Chart (DPR-ENF-072) and the chart outlining District Attorney Prosecution of Pesticide Violations under the FAC attached to Enforcement Letter 2023-02.

The changes to the two charts are:

  • Enforcement and Compliance Options Chart – revised amounts to be consistent with recent changes to Title 3, California Code of Regulations section 6130, increased the statute of limitations.
  • District Attorney Prosecution of Pesticide Violations – increased the statute of limitations.

Please have your staff begin using these new charts immediately.
