Updates to Volume 3, Restricted Materials and Permitting, Pesticide Use Enforcement Program Standards Compendium Appendices

This letter announces the availability of and summarizes updates to Volume 3, Restricted Materials and Permitting, Appendix J, 1,3 Dichloropropene (Field Fumigant) Recommended Permit Conditions and Appendix K, Chloropicrin and Chloropicrin in Combination with Other Products (Field Fumigant) Recommended Permit Conditions of the Pesticide Use Enforcement Program Standards Compendium, incorporating the updates to Title 3 California Code of Regulations (3CCR) effective January 1, 2024.

Appendix J is updated to include:

  • Annual use limit for each township for all townships in California of 136,000 adjusted total pounds (ATP). The annual township use limit is fixed and cannot be exceeded.
  • Pesticide use reports must be submitted electronically to the Commissioner.
  • Guidance for Regulations, effective January 1, 2024:
    • Approved list of Totally Impermeable Film (TIF) Tarpaulins and setback restrictions for overlapping applications. TIF Tarpaulins and Setback calculator list available at DPR’s website
    • Options for determining soil moisture levels
    • Several new field fumigation methods and codes; methods not specified are no longer allowed such as fumigation code 1290.

Appendix K is updated to include:

  • Removal of certain conditions that are now duplicative on the California labeling for chloropicrin products.
  • Defined combination applications
  • Requires the County Agricultural Commissioner be notified if the emergency response plan is implemented.
  • Tree hole fumigation limitations, including maximum number of tree holes and acreage allowed to be treated for any site in a 24-hour period.
  • Overlapping buffer zones with example scenarios.

In addition to the updated appendices and to assist in determining the appropriate requirements for products that contain both 1,3-Dichloropropene and chloropicrin active ingredients, a table was created that summarizes and compares the Department’s requirements and recommendations for each product.
