Written Notice of Proposed Action Template for Agricultural Civil Penalty Actions

Enclosed is the “Written Notice of Proposed Action Template for Agricultural Civil Penalty Actions.” The purpose of the template is to facilitate and encourage statewide consistency when County Agricultural Commissioners issue Notices of Proposed Action (NOPA) in conjunction with activities authorized by Food and Agricultural Code section 12999.5 (agricultural civil penalties).

This guidance is current and replaces other examples previously provided in the Hearing Officer Sourcebook, the Hearing Officer Roundtable Project, or the template in ENF 2006-002. This template is provided to you in a format with comments in the left hand column, as well as instructions in italics, to assist you in preparing NOPAs. Also provided is a separate “NOPA text only” version of the template (without comments or instruction).

We recommend reviewing your current agricultural civil penalty NOPA documents to ensure they are consistent with the template. A structural civil penalty NOPA template will be available in 2007.
